These Terms of Service govern your use of ScalesBySuzy (the "Service"), operated by Artwork by Suzy, LLC, d/b/a Software by Suzy. By creating an account or subscribing, you agree to these terms.
ScalesBySuzy helps musicians learn scales across instruments and tunings. Access requires an account and, after any trial period, an active paid subscription or one-time lifetime purchase.
You must be 13 years of age or older to create an account and use the Service. By creating an account, you represent that you are at least 13. The Service is not directed at children under 13, and we do not knowingly collect personal information from children under 13.
New subscribers may access a free trial requiring 7 days of active login (not 7 calendar days) to explore the Service. No payment method is required to begin a trial. The trial must be completed within 30 days of signup; if the 7 required login-days are not completed within that window, or upon your 8th login attempt (whichever comes first), you will be prompted to enter payment information to continue using the Service.
A "new subscriber" eligible for a trial is someone who has not held an active or paid ScalesBySuzy account, and has not used a ScalesBySuzy trial, at any point in the preceding 12 months. We reserve the right to deny or revoke trial access, and to charge for continued use, if we determine a trial was requested in violation of this eligibility rule.
We offer Monthly and Annual subscription plans, and a one-time Lifetime plan:
Subscriptions are billed in advance on a recurring basis through our payment processor, Stripe, and renew automatically until cancelled. Pricing for Monthly and Annual plans may change at any time; existing subscribers are not guaranteed to retain prior pricing upon renewal.
Lifetime Access. "Lifetime" means the earlier of: (a) the Customer's death, or (b) ScalesBySuzy ceasing to be offered as a product or service (including discontinuation, sale of the underlying business or app to a third party who does not assume this obligation, or cessation of operations by Artwork by Suzy, LLC, d/b/a Software by Suzy). Lifetime Access does not transfer to another person upon the Customer's death or otherwise, is non-refundable, and does not guarantee any particular feature set, uptime, or level of support — only continued account access for as long as the product is offered under these terms.
Future Premium Features. If ScalesBySuzy introduces premium features in the future, Lifetime members will receive access to those features at no additional cost. Monthly and annual subscribers are not guaranteed access to future premium features; ScalesBySuzy may offer such features as part of the existing plan, as a trial, as a paid upsell, or not at all, at its discretion.
Feedback-Based Extensions. Members who submit 3 or more pieces of feedback within a rolling 30-day period automatically receive one additional free month of access. A single submission of significant value may also earn a manual one-month extension at ScalesBySuzy's discretion. This benefit applies to all members regardless of plan type.
Referral Rewards. A member who refers a new user receives one free month of access once the referred user becomes a paying subscriber (i.e., upon their first payment, not upon signup).
Comped and Beta Access. ScalesBySuzy may grant complimentary access (including permanent access) to select beta testers or other individuals at its sole discretion. Comped access does not constitute a purchase and confers no ownership or refund rights.
You may cancel your subscription at any time through the self-service Customer Portal, accessible from your account settings, or by contacting us at the email below. Cancellation takes effect at the end of your current billing period — you keep access until then, and are not billed again afterward.

Accounts are personal to you. You're responsible for keeping your login credentials secure and for all activity under your account.
The Service, including its software, design, and content, is owned by Artwork by Suzy, LLC, d/b/a Software by Suzy and is protected by applicable intellectual property laws. Your subscription grants you a limited, personal, non-transferable license to use the Service for your own learning. You may not copy, reproduce, distribute, or create derivative works from the Service without our permission.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that it will result in any particular learning outcome.
To the maximum extent permitted by law, Artwork by Suzy, LLC, d/b/a Software by Suzy's total liability to you for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
We may suspend or terminate your account for violation of these terms, non-payment, or abuse of the Service. We will make reasonable efforts to notify you before doing so, except in cases of suspected fraud or abuse.
These terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles. Any dispute arising from these terms or the Service will be resolved in the state or federal courts located in Oklahoma.
We may update these terms from time to time. Continued use of the Service after changes means you accept the updated terms.
